Mediation: The Basics

Mediation is an alternative dispute resolution (ADR) method in which a mediator (a neutral third party) facilitates discussions between the different sides of a dispute with the goal of helping them reach an agreement. The mediation process often includes joint sessions in which everyone participates and private discussions in which the mediator meets individually with each side.

The potential advantages of mediation versus litigation include lower costs, more privacy, quicker resolutions and more control over the process. Also, it provides a more collaborative approach to conflict management that can help protect important business relationships.

How Long Does Business Mediation Take?

Mediation length can vary based on the complexity of the case and other factors. Mediation of simpler commercial disputes might take hours. More complicated matters, such as multi-party mediation, might take several days.

Does Mediation Always Result In A Settlement?

No, a settlement is not mandatory in business and corporate mediation. If a mediation settlement cannot be reached, the dispute will need to be resolved through other methods, such as commercial litigation. However, even in these instances, the discussions held during mediation may provide building blocks for future solutions.

Our Mediation Rates

We understand that a desire to save money is a major reason many choose to pursue mediation. So, we aim to be as transparent as possible about our fees. Our standard mediation rates are:

  • Fee: $430 per hour, split evenly among the parties unless otherwise agreed by all parties. There is a
    3-hour minimum for all mediations and pre-settlement conferences, or $1290 total.
  • Half-day mediations and pre-suit settlement conferences typically start at 9:30am and 1:30pm.
    Should you require an alternative start time, please indicate so in your Booking Request.
  • Full-day mediations and pre-suit settlement conferences occur from 9:00am – 5:00pm (including an
    hour lunch). Additional time may be requested.
  • For complex matters, please reserve a full day to ensure the best possible outcome.
    Cancellation Fee: The minimum fee ($1290) will be charged if cancellation occurs less than 7 days
    prior to the scheduled date.
  • Cancellations should be in writing and following an agreement of all parties and counsel. Unless
    otherwise agreed, all parties and their counsel are equally responsible for any cancellation fee.
  • Travel: Travel will be billed at half the hourly rate ($215/hour). There is no charge for travel in
    Hillsborough County, Florida. Airfare and reasonable lodging will be added to the invoice if required
    for attendance.
